Photography Service Contract

This agreement is made between the Client, whose name and contact information are listed below, and Stephanie Mueller Photography.

All photographs will be shot in digital format. Digital photos will be made available on a private online gallery available for download, unless the Client specifically requests to have photos delivered on a USB flash drive. Photos will be delivered as high-resolution JPEG files and will be ready within 1-2 weeks, unless otherwise specified or requested before the session.

ARTISTIC RIGHTS

Images may be edited at Photographer’s discretion, and delivered images may not include all images shot. Photographer reserves the creative right to edit and release only those deemed professional in quality and within Photographer’s artistic standards. The Client agrees that Photographer will have complete creative control during the photography session and in post-processing. All delivered images will be processed for brightness and color correction. Photographer will not edit for physical size, hair, or any other physical appearance issue other than blemishes. No re-editing will be done after the final edited copies have been delivered to the Client, unless an additional fee is previously agreed upon. The Client agrees that Photographer can only capture the event that happens: weather, location, time restraints, and subjects’ ability to cooperate are all factors in the quality of the photographs.

COMMERCIAL USE

The Client agrees that the prints and/or digital files are for personal use only and shall not be reproduced for commercial use. Photographer retains the right to use the photographs for the purpose of advertising or otherwise promotion of their work after obtaining permission from the Client.

SOCIAL MEDIA

This clause applies to social media including, but not limited to, Facebook, Instagram, and blogs. When published online, it is required that credit of Photographer be made. The Client agrees that Photographer’s images cannot be altered in color or edited in any way, including filters.

FEES

The rate for photography service is $125 per hour. Length of photography session must be specified upon signing this contract. If the Client requests to extend the length of photography service after signing this contract, a rate of $150 per hour will apply to the additional hours of photography service. Requests to extend the length of photography service must be made by time of the photo session. If the Client requests to extend the length of photography service after the photo session has started, an additional fee of $75 will be applied.

A reasonable travel fee may apply to any photography session that occurs outside of the New York City area.

CANCELLATION

The Client may request to reschedule or cancel the photography session up to 48 hours before to the originally scheduled date and time. If the Client requests to cancel or reschedule the photo session within 48 hours of the scheduled date and time, the Client agrees to pay Photographer a non-refundable fee of $75.

PAYMENT

Full payment of the agreed upon amount is due to Photographer prior to the end of the photography session. Payment must be made by personal check, cash, or Venmo. No photographs will be delivered until full payment is made.
